Last week, Member Miscimarra recently began tweeting out new NLRB decisions in which he authored an opinion separate from the majority opinion, along with a brief description of the decision and a handy reference to the page on which his opinion commences.  By definition, this is a good clue that the decision is controversial, may be of particular importance to employers, and is ripe for challenge at the court of appeals, with Member Miscimarra doing his level best to provide a road map for a court inclined to disagree with the NLRB’s current majority.
